Florida Lemon Law Process
This information outlines the process for Florida’s Lemon Law and the requirement to use state-certified, manufacturer-sponsored informal dispute programs before proceeding to the Florida New Motor Vehicle Arbitration Board.
Program Details:
- Certification Extended: These programs are provisionally certified until April 30, 2026.
- Programs & Manufacturers:
- BBB Auto Line: Bentley, Ford, GM, Hyundai (including Genesis), Kia, Mazda, Nissan (including Infiniti), Volkswagen/Audi.
- NCDS: Toyota (including Lexus), Honda (including Acura) for vehicles purchased on or after Nov 1, 2022, Tesla for vehicles purchased on or after Nov 1, 2022.
- CAP Motors: Porsche.
- Your Responsibility:
- Manufacturers must provide written info on how to file a claim at purchase/lease.
- You must apply to the manufacturer-sponsored program first before going to the state-run arbitration board.
- Deadlines:
- Apply to the manufacturer program within 60 days after the Lemon Law rights period ends (which is 24 months from delivery).
- If the manufacturer program doesn’t decide within 40 days or you’re dissatisfied, you can file with the state board.
- File with the state board within 60 days after the Lemon Law rights period ends OR 30 days after the manufacturer program’s final action, whichever is later.
- Warning: Avoid non-certified programs—they can cost you time and jeopardize your Lemon Law rights.
